Welcome to 3rd Eye Watching (“Company,” “we,” “our,” “us”). By accessing our website, purchasing products, or participating in services, you agree to the following Terms & Conditions.

 

1. Eligibility

• You must be at least 21 years of age to purchase products and act in accordance with all federal and state laws.

• You may not purchase or possess any product prohibited under local, state, or federal law.

• You are responsible for ensuring you are legally eligible to receive products in your jurisdiction.

 

2. Compliance with Laws

• Customers are responsible for knowing and complying with all applicable laws.

• We reserve the right to cancel any order that may violate federal, state, or local regulations.

 

3. Liability Disclaimer

• 3rd Eye Watching assumes no responsibility for misuse of any product purchased.

 

4. Privacy Policy

We are committed to protecting your privacy. Information collected may include:

• Name, contact details, demographic information, and preferences.

• Data used for internal record keeping, service improvements, promotions, and market research.

We may update this policy periodically.

Continued use of our website or services constitutes acceptance of changes.

 

5. Firearms Training Services

 

Eligibility

• Participants must be at least 18 years old.

• Minors ages 8 to 17 years old may attend only with a paid parent/guardian, who assumes full responsibility for minors' actions/behaviors. Parent/guardian must be in class with minor for the full duration of the class period. 

 

Cancellation/Registration & Rescheduling Policy

We kindly request that you notify us of any changes to your appointment at least 24 hours before

its scheduled start time.  All class and Live Scan fees are non-refundable. Appointments can be rescheduled or transferred to someone else up to 24 hours before your appointment time without penalty by sending an email to nakita_price@3rdeyewatching.com

·        Failure to cancel, no-show, or arriving late (15 minutes or more) will result in:

An additional charge of up to $25.00 for the inconvenience.

 

Refund Policy

No cash refunds will be issued for any reason. Customers are responsible for shipping costs in the event of an exchange by mail. Items purchased from our training room can be exchanged for a similar item of equal or lesser value, or store credit, within 14 days of purchase. Pepper sprays cannot be exchanged once opened. It is the buyer's responsibility to know the state laws regarding the purchase or possession of any items from us.

 

Safety Requirements

Strict adherence to instructor directions and safety protocols is mandatory. Failure to comply will result in removal from class and immediate failure of any certification or qualification.

Mandatory 1-hour remediation safety training for $60.00 before re-enrollment in any class. 

 

Assumption of Risk & Waiver

Firearms training involves inherent risks. By participating, you assume all risks and release 3rd Eye Watching, its owners, instructors, and affiliates from liability for injury, property damage, or death.

 

Medical Authorization

You authorize us to secure emergency medical treatment if needed.

Costs are your responsibility.

 

Media Release

By attending, you consent to photography/video for promotional use unless you notify us in writing beforehand.

 

Intellectual Property

All training materials are the property of 3rd Eye Watching and may not be reproduced without written & notarized consent.

 

⚠️ 6. Ammunition Shipment Policy

We are a licensed California Ammunition Vendor. 

We do not sell ammunition online.

 

Requirements to send your shipment to us

After ordering from your preferred retailer, please contact us by email with your name, contact info, tracking number, and a copy of your purchase receipt.

Ammo Shipment Acceptance Fees

$30 acceptance fee + $5 DOJ background check. 

11% excise tax (Assembly Bill 28), 

Law Enforcement & Peace Officers are exempt from paying excise tax with valid credentials

 

Discounted Rates (Ammo Shipments)

• Students: $10 + $5 DOJ Fee

• First Responders & Military: $10 + $5 DOJ Fee

• General Public: $30 + $5 DOJ Fee

 

Background Checks

All ammunition transfers require a DOJ background check. You must be at least 21 years old & own a legally registered firearm for all ammunition shipments & purchases (CA LAW), 

Standard check: $5.00 & if unsuccessful, Basic check: $19.00

Only the purchaser may pick up shipments. Name on shipping label & purchase receipt must match the ID of the person picking up. We take these background checks seriously to ensure compliance with California regulations and to prioritize the safety of our customers and the community. By implementing this policy, we aim to prevent the unauthorized sale of ammunition and promote responsible firearm ownership within our state.

 

Your shipment CAN NOT be picked up by ANYONE but YOU "the purchaser".

If you fail the ammunition background check, you will have 30 days to contact the DOJ to fix the problem, and you will incur storage fees at $10.00 per day.

FEES WILL NOT BE REFUNDED 

⚠️If a straw purchase is suspected

We WILL NOT RELEASE your shipment to you; your information will be turned over to law enforcement for them to decide what happens next & your shipment will be donated to our training department. 

 

Storage Policy

• Pickup must be scheduled within 7 days of notification.

• Grace period: On the 8th day after notification, storage fees apply at $10 per day up to 45 days.

• After 45 days, shipments are considered abandoned and donated to our training department.

• Past-due storage fees must be paid in full, plus a 12% billing fee, before future shipments are accepted again.

 

7. Governing Law

These Terms are governed by the laws of the State of California. Disputes will be resolved via third-party arbitration, with costs assigned by the arbiter unless otherwise agreed in writing.

Payment Options:

• We prefer Cash and Zelle (no processing fees)

• Card payments are accepted but processing fees will be applied

• (Card processing fees of 4% +$0.30 per transaction will be applied to all card payments. 

• Prices are clearly listed & processing fees are stated for transparency.

• All class fees are non-refundable; rescheduling is available with notice
