Welcome to 3rd Eye Watching ("Company", "we", "our", or "us"). By accessing our website, purchasing our products, or utilizing our services, you agree to comply with and be bound by the following Terms and Conditions.

1. Eligibility
By using this site or purchasing from us, you confirm that:
•    You are at least 21 years of age for ammunition & at least 18 for our less lethal products & you are acting in accordance with federal & state laws.
•    You are not prohibited from owning or possessing ANY PRODUCT we sell under local, state, or federal law.
•    You are legally allowed to receive products in your jurisdiction.

2. Compliance with Laws
It is your responsibility to know and comply with all federal, state, and local laws regarding ANY OF THE PRODUTS SOLD ON OUR WEBSITE OR IN OUR STORE. We reserve the right to cancel any order that we believe violates any applicable laws.

3. Ammunition and Accessory Purchases

  • You must follow all federal, state, and local laws regarding the purchase and possession of ammunition and accessories.

  • A background check is required by the state of California for ALL purchases of ammunition.

  • We accept shipments of ammunition that was purchased from a 3rd party retailer on your behalf. A fee is associated with this service as well as the required background check. Shipments can only be processed & released to the purchaser with proper identification.

    4. Returns and Cancellations
    •    Accessories and Ammunition: Returns are accepted within 10 days if the product is unused, undamaged and in original packaging. Return shipping is at the buyer’s expense.
    •    A restocking fee of up to 30% may apply for cancelled orders.

6. Shipping Policy

  •  We only ship within the United States where permitted by law.

  • CHECK THE LAWS IN YOUR STATE BEFORE PURCHASING ANY OF OUR ITEMS. SOME ITEMS MAY BE PROHIBITED FROM MAILING TO YOUR STATE. 

  • Customers are responsible for all shipping costs.

  • A new item or store credit will be issued only after the returned item has been received and verified to be undamaged and in resalable condition.

  • A restocking fee of up to 30% may be applied at the discretion of the owner. 

  • No cash refunds for any reason.

  • A physical address is required (NO PO BOX)

  • PURCHASES WILL BE SHIPPED WITHIN 10 BUSINESS DAYS

  • An email confirmation with a tracking number will be provided

  • You are responsible for any additional fees, such as transfer fees or state-mandated taxes or compliance requirements.

Firearms Training Services Terms Conditions & Policies

1. Acceptance of Terms

By registering for or participating in any firearms training course offered by 3rd Eye Watching (“Company”, “we”, “us”),

you (“Participant”, “you”) agree to be bound by these Terms and Conditions.

If you do not agree, do not participate in the training services.

2. Eligibility and Legal Compliance

You must be at least 18 years of age to attend any classes taught by us. Children under the age of 18 years old are allowed to attend classes ONLY with a parent or guardian. Parent or Guardian must be responsible for the child or children during the duration of the training including classroom & range activities and assumes all liability for children just as you would yourself.

3. Course Registration and Payment

  • Full payment is required to reserve your seat in a course.

  • Cancellation by participant less than 12 hours before the class will result in a inconvenience fee of $20.00. No Cash Refunds For Any Reason

  • We reserve the right to reschedule or cancel any class due to unforeseen circumstances (minimum enrollment not met, weather, instructor illness, etc.). If this occurs, participants will be notified and rescheduled or issued store credit to be used at a later date.

4. Safety Requirements

Firearms safety is our top priority. All participants must:

  • Follow all instructor directions without hesitation.

  • Handle all firearms responsibly and safely at all times.

  • Use only authorized firearms and ammunition during class.

  • Wear appropriate clothing, including closed-toe shoes, eye and ear protection.

Failure to comply with safety standards will result in immediate removal from the class.

No Refunds Will Be Given for Any Reason & You Will Not Be Able to Book ANY Other Classes with Us Until You have gone through a Firearm Safety Remediation Course with our instructor.

​5. Assumption of Risk and Waiver of Liability & Acknowledgment of Risk:

By participating in firearms training, you acknowledge that the use of firearms involves inherent risk of injury or death, including but not limited to:

  • Discharge of firearms

  • Accidental injury from others in the class

  • Equipment malfunction

  • Environmental risks at the range or training facility

You voluntarily assume all such risks.

Waiver and Release:

By signing up for training, you agree to release, waive, and discharge 3rd Eye Watching, its owners, instructors, affiliates, agents, and employees from any and all liability for:

  • Personal injury

  • Property damage

  • Accidents

  • Death

  • Any loss resulting from your participation in firearms training

This waiver includes negligence by the company or its agents and applies to both on-site and off-site training events.

6. Medical Authorization

You authorize 3rd Eye Watching and its representatives to secure emergency medical treatment on your behalf in the event of injury or illness during a course. You are responsible for any associated medical costs.

7. Photography and Media Release

By attending a course, you consent to photography or video recording for promotional purposes unless you notify us in writing prior to the course.

8. Intellectual Property

All training materials, course content, and instructional methods are the property of 3rd Eye Watching and may not be reproduced, recorded, or distributed without prior written consent.

9. Modifications to Terms

We reserve the right to update these Terms and Conditions at any time. Continued participation after changes implies acceptance.

10. Governing Law

These Terms are governed by the laws of the State of California.  

Any disputes shall be resolved via 3rd party arbitration services & all costs associated with the arbitration will be the sole responsibility of the person who initiated the arbitration unless otherwise specified by arbiter and agreed to in writing by both parties.

Ammunition Shipment Acceptance Policy​

 

By booking this appointment you agree that you have been contacted by us (email or text) informing you of your shipments arrival as well as agreeing to our terms and conditions listed below.

 

This is an agreement between you "the purchaser" & us "the ammo vendor" for accepting customer ammunition shipments and for storage of that shipment while waiting for pickup. This includes any/all fees to be charged for the acceptance of shipments on your behalf as well as our storage policy and fees associated with accepting your shipment.

All ammunition shipments & purchases require a Department of Justice Ammunition Background Check in accordance with California law. To pass this background check, it is mandatory for the purchaser to be a US Citizen/Permanent Resident Alien & have a LEGALLY registered firearm on file with the Department of Justice. This requirement ensures that ammunition is only sold to individuals who are eligible to possess firearms under California state law.

Our company follows a two-tiered background check process for ammunition purchases. The first tier is the Standard Background Check, which costs $1.00 and will be attempted initially. If the standard check does not provide satisfactory results, a Basic Background Check will be conducted as a secondary measure at a cost of $19.00.

We take these background checks seriously to ensure compliance with California regulations and to prioritize the safety of our customers and the community. By implementing this policy, we aim to prevent the unauthorized sale of ammunition and promote responsible firearm ownership within the state. Your shipment CAN NOT be picked up by ANYONE but YOU "the purchaser".

If you fail the DOJ background, check you will have 30 days to contact DOJ to fix the problem

AND you will incur storage fees at $10.00 per day.

NO FEES WILL NOT BE REFUNDED

If a straw purchase is suspected,

we WILL NOT RELEASE your shipment to you

& your information will be turned over to law enforcement for them to decide what happens next.

Ammunition Storage Fees & Policy

You will be notified of your shipment's arrival through email. Once notified, you agree to book a pickup appointment within 48 hours to ensure the timely retrieval of your shipment. We understand that unforeseen circumstances may arise, so we allow a grace period of 7 days for you to come and pick up your shipment. Your grace period starts 24 hours after being notified of us receiving your shipment.

However, if you fail to retrieve your shipment within this grace period, you will incur storage fees at a rate of $10.00 per day up to 45 days. It is essential for you to promptly schedule a pickup appointment to avoid any unnecessary storage fees and ensure the smooth delivery of your goods. If the shipment isn't picked up by the end of business day 45 your shipment will be considered abandoned and will be donated to our training department. We will not accept any further shipments on your behalf until ALL PAST DUE FEES ARE PAID IN FULL + 12% BILLING FEE.
