3rd Eye Watching – Terms, Conditions, and Policies
Welcome to 3rd Eye Watching (“Company,” “we,” “our,” “us”). By accessing our website, purchasing our products, or registering for our training, fingerprinting, or ammunition services, you legally agree to the following terms.
General Eligibility & Age Restrictions
Minimum Age: You must be at least 18 years old to purchase less-lethal products or register for adult training services.
Legal Responsibility: You are strictly responsible for knowing and complying with all local, state, and federal laws regarding the purchase or possession of items from us.
Right to Cancel: We reserve the right to cancel any order or service registration that we suspect may violate regulations.
Firearms Training Services
Adult: Participants at least 18 years of age
Minor Policy (Ages 8-17): Minors may attend only with a paid parent or legal guardian. The parent/guardian must remain in the classroom and on the range for the full duration of the class, assuming total responsibility for the minor's behavior and actions.
Strict Safety Requirements:
Strict adherence to all instructor directions and safety protocols is mandatory. Failure to comply will result in immediate removal from class and automatic failure of any certification or qualification.
Mandatory Remediation:
Any student removed from a class due to safety violations must complete a mandatory 1-hour safety remediation training session ($60.00 fee) before they are permitted to re-enroll in any future classes.
Registration, Cancellation, and Late Policies
No Cash Refunds:
All class registration, service, and Live Scan fingerprinting fees are strictly non-refundable.
No cash refunds will be issued for any reason.
Rescheduling and Transfers:
You may reschedule your appointment or transfer your registration to another individual up to 24 hours before your scheduled time without penalty by emailing nakita_price@3rdeyewatching.com
Late Arrivals & No-Shows:
If you fail to cancel 24 hours in advance, do not show up, or arrive 10 minutes or more late to your class, you forfeit your slot and will be charged an additional $30.00 inconvenience fee to reschedule.
Product Exchange & Return Policy
14-Day Window:
Unopened items may be exchanged for a similar item of equal or lesser value, or for store credit, within 14 days of purchase.
Exclusion:
Pepper sprays cannot be exchanged or returned once opened.
Shipping Fees:
The customer is entirely responsible for all shipping costs associated with exchanges handled by mail.
California Ammunition Vendor & Shipment Policy
We are a licensed California Ammunition Vendor. We sell ammunition in-person only. If you choose to have an online ammunition order shipped to our facility, you must adhere to the following rules:
Mandatory Notification:
Immediately after ordering from an online retailer, you must email your name, contact information, tracking number, and a copy of your purchase receipt to shipments@3rdeyewatching.com
Identity Verification:
Only the exact individual named on the purchase receipt and shipping label may pick up the shipment. Your physical ID must match the shipment details perfectly. No third-party pickups are allowed under any circumstances.
Acceptance & DOJ Background Check Fees:
General Public: $30.00 Acceptance Fee + $5.00 DOJ Background Check Fee.
Students / First Responders / Active Military: Discounted $10.00 Acceptance Fee + $5.00 DOJ Background Check Fee.
California 11% Excise Tax (AB 28):
All ammunition transfers are subject to the California 11% firearms and ammunition excise tax. Credentialed Law Enforcement and Peace Officers are exempt from this excise tax upon presentation of valid credentials.
DOJ Background Check Compliance:
Per California law, you must be at least 21 years old and own a legally registered firearm in the state to clear the background check. A standard background check is $5.00. If a standard check is unsuccessful, a basic check is $19.00. Fees are non-refundable.
Background Check Failure:
If you fail your background check, you have 30 days to resolve the issue with the DOJ. During this time, you will incur a storage fee of $10.00 per day.
Storage & Abandonment:
You must schedule a pickup within 7 days of being notified that your shipment has arrived. On the 8th day, a $10.00 per day storage fee applies, up to a maximum of 45 days. After 45 days, the shipment is legally deemed abandoned and will be donated to our training department. Past-due storage fees plus a 12% billing fee must be settled before we will accept any future shipments for you.
Suspected Straw Purchases:
If we have reason to suspect a straw purchase (buying ammunition illegally for someone else), we will not release the shipment. Your information will be turned over to law enforcement immediately, and the ammunition will be forfeited and donated to our training department.
Legal Protections, Waivers, and Permissions
Assumption of Risk & Liability Release:
Firearms training and less-lethal defensive tools involve inherent risks of property damage, personal injury, or death. By participating in our classes or purchasing products, you voluntarily assume all associated risks and completely release 3rd Eye Watching, its owners, instructors, and affiliates from all liability.
Medical Authorization:
In the event of an emergency during a class, you authorize 3rd Eye Watching to secure professional medical treatment on your behalf. You assume full financial responsibility for all resulting medical costs.
Media Release Permission:
By attending our courses, you consent to being photographed or recorded on video for promotional and marketing purposes. If you do not wish to be recorded, you must notify us explicitly in writing before your class begins.
Intellectual Property Protection:
All training curricula, hand-outs, media, and digital materials are the exclusive property of 3rd Eye Watching. Replication, distribution, or reproduction of these materials without express, written, and notarized consent is strictly prohibited.
California Price Transparency & Payment Policy
In strict compliance with California price transparency laws, all default rates displayed on our website represent our all-inclusive standard credit and debit card pricing. This is the maximum amount you will pay. Because payment finalization occurs in person at our facility, an immediate incentive discount is applied to clients who choose to settle their balances via Cash or Zelle.
Governing Law & Dispute Resolution
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California. Any legal disputes arising from our services or products will be resolved through binding, third-party arbitration. Arbitration costs will be allocated by the arbitrator unless otherwise agreed upon in writing.
